Platform Terms (Creators & Brands)

These Platform Terms govern how content creators (“Creators”) and businesses (“Brands”) use the Lydia platform to find each other and run marketing campaigns. The platform is operated by LYDIA APP UK LTD (“Lydia”, “we”, “us” or “our”), based at Flat 6, 310 Finchley Road, London, NW3 7AG, United Kingdom.

By using Lydia as a Creator or a Brand, you agree to these Platform Terms. Our general Terms & Conditions and Privacy Policy also apply.

1. Lydia’s role

Lydia provides a platform that connects Creators and Brands and helps them arrange and run campaigns. For payments due to Creators, Lydia acts as a payment intermediary: we invoice the Brand, collect payment, deduct our commission, and pass the balance to the Creator. Lydia is not the Creator’s agent and does not assume liability for the Brand’s obligations.

Lydia is not the employer of any Creator. Creators act as independent contractors. Each campaign is an agreement between the participating Creator and Brand, which Lydia facilitates on the terms set out here and in the campaign proposal.

2. Eligibility and accounts

You must be at least 18 years old and able to enter into a binding contract. You agree to provide accurate information and to keep your account secure. Creators connect their social media accounts (such as Instagram, YouTube and TikTok) so that audience and engagement data can be used to match them with suitable campaigns.

3. Campaigns

Each campaign is defined in a campaign proposal that sets out the deliverables, timing, compensation and any content-licensing fee. A campaign is confirmed once both the Creator and the Brand have accepted the proposal. Creators agree to produce and publish the deliverables as described; Brands agree to provide the necessary materials and approvals within 3 business days of request.

4. Fees and payment

Lydia retains a commission of between 10% and 20% of the campaign fee, as stated in the campaign proposal. Invoicing, payment timing and payouts are set out in our Payment Conditions, which form part of these Platform Terms.

5. Content and usage rights

Ownership of campaign content, and the licence granted to Brands to use it, are governed by our Content Rights, which form part of these Platform Terms.

6. Creators’ obligations

Creators agree to:

  • create original content that complies with applicable law and platform rules — including advertising-disclosure rules, such as clearly labelling paid partnerships;
  • meet agreed deadlines; and
  • not engage in fraudulent activity such as fake engagement or misleading metrics.

7. Brands’ obligations

Brands agree to:

  • provide lawful and accurate campaign briefs and materials;
  • not require Creators to publish anything false, misleading or unlawful;
  • pay valid invoices within the agreed time; and
  • use campaign content only as permitted by the Content Rights.

8. Prohibited conduct

Both Creators and Brands agree not to circumvent the platform to avoid fees, misuse other users’ data, or use the platform for any unlawful, fraudulent or abusive purpose.

9. Disclaimers and liability

Lydia facilitates campaigns but does not guarantee the performance, results or conduct of any Creator or Brand. Nothing in these Platform Terms excludes liability that cannot be excluded under applicable law. Subject to that, and to the extent permitted by law, Lydia is not liable for indirect or consequential loss, or for disputes between a Creator and a Brand. Disputes between Creators and Brands are their own responsibility to resolve.

10. Suspension and termination

We may suspend or close an account that breaches these Platform Terms or the law. You may stop using the platform at any time, subject to fulfilling any deliverables under a campaign you have already confirmed and which remains active.

11. Disputes

Disputes about a campaign, payment or content rights are between the Creator and Brand concerned. For platform-related queries only, you may contact Lydia at legal@lydia.so. Lydia may provide relevant records to assist parties in resolving their dispute but does not act as mediator.

12. Changes and governing law

We may update these Platform Terms from time to time and will post the updated version with a new “Last updated” date. These Platform Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute.
